Conciliatory Proceedings vs. Court Proceedings

Participation in conciliatory proceedings does not exclude the option to pursue claims in court proceedings. The suggestion of dispute resolution presented may differ from the resolution that could follow from court proceedings.


Initiation of out-of-court proceedings on resolution of consumer disputes interrupts the period of limitation of the claim subject to dispute. Such limitation does not continue until these proceedings are finalised (the proceedings end with preparation of the final report). This means that upon completion of the proceedings if you are still not satisfied with the resolution of the dispute, you will have an opportunity to turn to the court in order to pursue your rights.


Remember to include the information as to whether the Parties to the dispute have undertaken any attempt to mediate or any other out-of-court dispute resolution, in a potential court suit; if such attempts have not been undertaken, explain the reasons of the failure to undertake them.
