Legal Basis

The legal basis underlying the operations of the Rail Passenger Rights Ombudsman is as follows:

• the Act on Out-of-Court Resolution of Consumer Disputes (so called ADR [Alternative Dispute Resolution] Act) of 23 September 2016 [ustawa z dnia 23 września 2016 r. o pozasądowym rozwiązywaniu sporów konsumenckich (tzw. ustawa o ADR – z ang. Alternative Dispute Resolution)];

• the Act on Railway Transport of 29 March 2003 [ustawa z dnia 28 marca 2003 r. o transporcie kolejowym];

• Regulation of the Minister of Infrastructure and Civil Engineering of 25 April 2017 on organisation of the Railway Passenger Rights Ombudsman and proceedings on out-of-court resolution of passenger disputes [Rozporządzenie Ministra Infrastruktury i Budownictwa z dnia 25 kwietnia 2017 r. w sprawie organizacji instytucji Rzecznika Praw Pasażera Kolei Ombudsman oraz proceedings w sprawie pozasądowego rozwiązywania sporów pasażerskich].

Contractual provisions and legal acts including in particular the ones presented below may provide a basis for dispute resolution:

• Regulation (EC) No 1371 of the European Parliament and of the Council of 23 October 2007 on rail passenger’s rights and obligations;

• the Act on Transportation of 15 November 1984 [Ustawa z dnia 15 listopada 1984 r. – Prawo przewozowe];

• the Act on the Civil Code of 23 April 1964 [Ustawa z dnia 23 kwietnia 1964 r. – Kodeks cywilny].
